1. Agreement and Acceptance
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and StreetScout ("we," "us," or "our") governing your access to and use of the StreetScout website, application, and related services (collectively, the "Service"). By creating an account, accessing, or using the Service, you agree to these Terms in their entirety.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
StreetScout is an AI-powered platform designed to assist homeowners in responding to HOA (Homeowners Association) violation notices. The Service includes, but is not limited to:
- Tools to organize and track HOA violation cases
- AI-assisted analysis of violation notices and HOA governing documents
- Draft response letters tailored to your situation and jurisdiction
- Document storage and question-answering capabilities for CC&Rs, bylaws, contracts, and related documents
- State-specific legal context and references (for informational purposes only)
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
3. Eligibility
You must be at least 18 years of age and have the legal capacity to enter into a binding contract to use the Service. The Service is intended for users in the United States. By using the Service, you represent that you meet these requirements. If you do not, you may not access or use the Service.
4. Account Registration and Security
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Keep your password confidential and secure
- Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are fraudulent or abusive.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws, regulations, or third-party rights
- Impersonate any person or entity or misrepresent your affiliation
- Upload malicious code, viruses, or harmful content
- Attempt to gain unauthorized access to our systems, other accounts, or third-party networks
- Scrape, harvest, or automate access to the Service without our permission
- Interfere with or disrupt the Service or its infrastructure
- Use the Service for any illegal or fraudulent purpose
We may investigate and take appropriate action, including suspension or termination of your account, if we reasonably believe you have violated this section.
6. User Content and Licenses
You retain ownership of content you upload to the Service, including documents, photos, and other materials ("User Content"). By uploading User Content, you grant us a non-exclusive, royalty-free, worldwide license to store, process, display, and use your User Content solely to provide and improve the Service. This includes using your documents to generate letters and answer questions about your HOA governing documents.
You represent that you have the right to upload all User Content and that it does not infringe any third-party rights. We do not claim ownership of your User Content.
7. Intellectual Property
The Service, including its design, features, software, text, graphics, and other content (excluding User Content), is owned by StreetScout and is protected by intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our prior written consent. All rights not expressly granted are reserved.
8. Privacy and Data Use
Your use of the Service is also governed by our Privacy Policy. We collect and process personal information solely to provide the Service to you. Specifically:
- Your documents and case data (violation notices, HOA documents, letters, and related materials) are used exclusively to provide analysis and generate response letters for your own cases. They are not shared with other users or used to train models without your explicit consent.
- Anonymous, aggregated neighborhood enforcement data may be collected and used to power community features such as neighborhood enforcement trends. This data collection is entirely opt-in: you will be asked for your consent before any of your case outcomes or violation patterns are included, and you may withdraw consent at any time in your account settings.

9. Not Legal Advice
This application does NOT provide legal advice. The information, documents, analysis, and generated content provided by the Service are for general informational purposes only and should not be construed as legal advice.
No attorney-client relationship is created between you and the creators, operators, or providers of this Service through your use of the application. Legal advice can only be provided by a licensed attorney who is familiar with the specific facts of your situation and the applicable laws in your jurisdiction.
You should not rely on any content from the Service as a substitute for professional legal counsel. For legal matters, always consult a qualified attorney licensed in your state.
10. AI-Generated Content Limitations
This application uses artificial intelligence (AI) to analyze documents, generate response letters, and provide defense strategies. AI systems, while powerful, can and do make errors including:
- Factual inaccuracies: AI may misinterpret documents or generate incorrect information
- Incorrect legal citations: References to laws, statutes, or governing documents may be wrong or inapplicable
- Misapplication of law: AI may incorrectly apply legal principles to your situation
- Incomplete analysis: AI may miss important details, rights, or obligations
- Outdated information: Laws and regulations change; AI may not reflect current law
- Hallucinations: AI may generate plausible-sounding but entirely fictional information
11. Your Responsibilities
You are solely responsible for:
- Verifying all information: Check all facts, dates, amounts, and citations before using any generated content
- Reviewing all documents: Carefully review any letters or documents before sending them to your HOA or any other party
- Consulting an attorney: Seek advice from a qualified attorney licensed in your state before taking any legal action or making legal decisions
- Understanding your governing documents: Read and understand your CC&Rs, bylaws, contracts, and other HOA governing documents
- Meeting deadlines: You are responsible for responding to HOA notices within required timeframes
- Compliance with law: Ensuring your actions comply with all applicable federal, state, and local laws
12. Accuracy and Verification
Always verify independently:
- Confirm all dates, deadlines, and time periods against official HOA notices
- Verify all fine amounts and fee calculations
- Check that citations to governing documents are accurate by reviewing the actual documents
- Confirm that any legal principles or rights mentioned actually apply in your jurisdiction
- Review all generated letters for accuracy, tone, and appropriateness before sending
13. When to Consult an Attorney
You should consult with a qualified attorney if:
- You face significant fines or financial consequences
- Your HOA threatens legal action or foreclosure
- The violation could affect your property rights or home ownership
- You need to file a lawsuit or defend against one
- The situation involves complex legal issues or constitutional rights
- You are uncertain about any aspect of your rights or obligations
- You need legal representation at a hearing or in court
- The stakes are high and you want professional guidance
When in doubt, consult an attorney. The cost of legal advice is often far less than the cost of making a legal mistake.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: StreetScout and its creators, operators, and providers shall not be liable for any damages, losses, or consequences arising from:
- Your use or inability to use the Service
- Any errors, inaccuracies, or omissions in the information provided
- Any AI-generated content or analysis
- Any decisions you make based on information from the Service
- Any actions or inactions by your HOA or other third parties
- Missed deadlines, increased fines, legal action, or other adverse outcomes
This includes but is not limited to direct, indirect, incidental, consequential, punitive, or special damages, even if advised of the possibility of such damages. In no event shall our total liability exceed the greater of one hundred dollars (USD $100) or the amount you paid to us (if any) in the twelve months preceding the claim.
15. No Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided.
16. Indemnification
You agree to indemnify, defend, and hold harmless StreetScout and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party rights. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you.
17. Termination
We may suspend or terminate your account and access to the Service at any time, with or without cause or notice. You may terminate your account at any time by contacting us or through account settings, if available.
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 6–8, 11–16, and 18–22) will survive.
18. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Delaware for the resolution of any disputes arising from or relating to these Terms or the Service.
19. Dispute Resolution
Before filing a formal legal action, you agree to contact us and attempt to resolve any dispute informally. If we cannot resolve the dispute within thirty (30) days, either party may proceed with formal dispute resolution. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association, and judgment on the award may be entered in any court having jurisdiction. You and we waive any right to a jury trial.
20. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service. We encourage you to review these Terms periodically.
21. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the parties' intent.
22. Entire Agreement
These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and StreetScout regarding the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
